You know of the song, “You Always Hurt The One You Love”? Well…… ‘nuf
said. And since I’m the OLD lady of the group (at least no one else has
admitted to being born before 5/24/39), I have the right to instigate. He
spits, stomps, wails, and whatever lil’ boys do to get attention. He’s
probably throwing rocks at us but they only land in his backyard. If he has
you for dinner — oooops!

Come to think of it, my non-DM dau had scarlet fever and missed 39
non-consecutive days one year (about ‘68). The school never questioned that.

We haven’t had the meeting yet. It is scheduled for the 26th of January
at 9a.m.
I have spoken with the principle several times this week. In fact today was
the first day that I didn’t spend entirely on the phone. Tuesday we
discussed the forms in Es’ file and I asked if she had a 504, and if not
why. The principle tried to tell me that it wasn’t something I needed etc…
*really* trying to steer me away from wanting one. I was told by the PACER
center to request a 504, and a copy of the 504 Compliance Manual in writing,
which I did on Wednesday, and I have not heard back about that yet. I will
be satisfied with filling out the 504 at that meeting, since everyone is
required to sign it. (a 504 is basically the same as a Individualized Health
Plan outlining Es’s care requirements, the difference between the two is
that *everyone* involved in Es’ care has to sign the 504. The only sig
required on the IHP is the parent or guardians) So, with out a 504 if
something happens to Es at school I have little legal recourse because the

I thought I would add this (that I wish Diabetes
Interview had put in their article), the most
important point to what happened in our situation
concerning the OCR agreement is that it will be used
as a model for other counties in US where parents are
experiencing similar discrimination. If any parent
with a child with diabetes has anything less in their
school system than what our agreement outlines all
that parent has to do is file a complaint with their
regional OCR on behalf of their child. Also, OCR,
DREDF and ADA are working on a means to implement
nationwide, but this may take awhile.
